Cancellation and Refund Policy
Effective January 1, 2025 · Applies to all reservations made through booking.bnbhost.ca
1. Purpose and Scope
This Cancellation and Refund Policy ("Policy") forms part of the Terms and Conditions governing all bookings made through booking.bnbhost.ca ("the Platform," "we," "us," or "our").
By completing a booking, the individual making the reservation ("Guest," "you," or "your") acknowledges and agrees to be legally bound by the terms set forth herein.
This Policy establishes clear, fair, and enforceable rules regarding cancellations, refunds, and chargeback prevention, in compliance with applicable consumer protection and payment processing regulations.
2. Definitions
For the purpose of this Policy:
- Booking Date
- The calendar date on which payment for the reservation was successfully processed.
- Check-In Date
- The first scheduled date of occupancy.
- Grace Period
- Forty-eight (48) hours following the Booking Date.
- Total Booking Amount
- The full amount paid by the Guest for the reservation, including all taxes and fees.
3. 48-Hour Grace Period (Full Refund Eligibility)
(a) Guests may cancel a reservation within forty-eight (48) hours of the Booking Date and receive a 100% refund of the Total Booking Amount, provided that the Check-In Date is at least fourteen (14) days after the cancellation request.
(b) To qualify for the refund, the Guest must submit a written cancellation request through their account on booking.bnbhost.ca or by email to contact@bnbhost.ca within the Grace Period.
(c) Refunds, once approved, will be issued to the original payment method within five to ten (5–10) business days, subject to standard bank processing times.
4. Non-Refundability After Grace Period
(a) Upon expiry of the Grace Period, all payments become final and non-refundable, regardless of the reason for cancellation, including but not limited to: changes in travel plans, medical issues, transportation delays, acts of God, or other unforeseen events.
(b) This non-refundability applies to all circumstances, including no-shows, early departures, or late arrivals.
(c) The Guest acknowledges that, after the Grace Period, cancellation of a reservation does not release the Guest from payment obligations, and no credits, partial refunds, or date changes will be issued.
5. Rescheduling and Transfer of Reservation
(a) After the expiration of the Grace Period, bookings are non-transferable and non-modifiable.
(b) Any request for a new date or change of reservation shall be treated as a new booking, subject to availability and current rates.
6. Payment Authorization and Chargeback Waiver
(a) By submitting payment, the Guest expressly authorizes booking.bnbhost.ca and its designated payment processor(s) to charge the Total Booking Amount to the Guest's provided payment method pursuant to this Policy.
(b) The Guest waives any right to initiate a chargeback, reversal, or payment dispute except in cases of proven unauthorized use of the Guest's payment method.
(c) Any chargeback or dispute initiated in contravention of this Policy shall constitute a breach of contract. booking.bnbhost.ca reserves the right to: submit documentation to the issuing financial institution; recover chargeback fees, administrative expenses, and reasonable legal costs; and suspend or permanently terminate the Guest's account.
(d) The Guest acknowledges that digital acceptance of the Platform's Terms and this Policy constitutes conclusive evidence of authorization under applicable payment network rules.
7. Recordkeeping and Evidentiary Use
(a) booking.bnbhost.ca maintains comprehensive electronic records, including: booking timestamps, IP addresses, payment confirmations, and policy acceptance logs.
(b) These records shall serve as conclusive proof of consent and may be relied upon in any legal, regulatory, or financial proceeding.
8. Exceptions and Force Majeure
(a) In the event of extraordinary and unforeseeable circumstances (e.g., natural disasters, government-imposed travel bans, or public health emergencies), booking.bnbhost.ca may, at its sole discretion, provide a partial refund, credit, or rebooking option.
(b) Such remedies are ex gratia, non-precedential, and shall not be interpreted as a waiver of the Platform's strict refund policy.
9. Limitation of Liability
Under no circumstances shall booking.bnbhost.ca or its affiliates be liable for any indirect, incidental, special, or consequential damages arising out of or relating to a booking, cancellation, or denial of refund, except as required by law.
10. Governing Law and Jurisdiction (Global Operations)
This Policy and any dispute arising from or relating to a reservation made through booking.bnbhost.ca shall be governed by and construed in accordance with the laws of the Province of British Columbia, Canada, and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
Any claim, dispute, or controversy shall be submitted to the exclusive jurisdiction of the courts of Vancouver, British Columbia, Canada, or, at booking.bnbhost.ca's sole discretion, resolved by binding arbitration in that jurisdiction.
booking.bnbhost.ca retains the right to bring proceedings in any jurisdiction where a property is located or where enforcement is required, to the extent necessary to protect its rights or enforce a judgment.
11. Acknowledgment and Acceptance
By proceeding with a booking on booking.bnbhost.ca, the Guest acknowledges that they have:
- Read, understood, and agreed to this Cancellation and Refund Policy;
- Accepted that all bookings become non-refundable after forty-eight (48) hours; and
- Authorized booking.bnbhost.ca to retain and present all booking and payment records as evidence of consent in any dispute resolution process.
