Legal Disclaimers and Limitation of Liability Policy

booking.bnbhost.ca is a booking intermediary. We do not own or control properties. Liability is limited as set out in this Policy.
1. Purpose of This Policy
This Policy defines the extent of booking.bnbhost.ca's responsibility and legal liability in connection with use of our website, platform, and services. By using the Services you acknowledge and agree to the limitations, disclaimers, and exclusions below.
2. Platform as an Intermediary
booking.bnbhost.ca is a booking intermediary, not a real estate broker, property owner, or property manager. We provide a platform for Hosts to list and manage properties and for Guests to discover, reserve, and pay for accommodations. We do not own, lease, or control listed properties. Each Host is solely responsible for the condition, safety, and legality of their property.
3. No Warranty or Representation
The Services and listings are provided "as-is" and "as-available" without warranty of any kind. We make no representations or warranties regarding accuracy of listings, performance or condition of any property, safety or habitability, suitability for a purpose, or conduct of any Host or Guest. We do not guarantee uninterrupted access, error-free operation, or secure transmission. Reliance on information provided is at your own risk.
4. Host Responsibilities
Each Host is independently responsible for maintaining the property in safe, habitable, lawful condition; complying with zoning, health, building, tax, and licensing laws; accurately representing the property; and providing accommodation as advertised. booking.bnbhost.ca is not responsible for a Host's failure to meet these obligations.
5. Guest Responsibilities
Each Guest is responsible for verifying that a property meets their requirements before booking; using the property lawfully and in accordance with House Rules; and obtaining appropriate travel, medical, or rental insurance. We are not liable for costs, injuries, or damages resulting from a Guest's actions or omissions.
6. No Agency or Employment Relationship
Use of the Platform does not create any partnership, joint venture, agency, or employment relationship between booking.bnbhost.ca and any Host or Guest. Hosts and Guests act solely as independent contractors or private individuals.
7. Third-Party Services and Links
The Platform may contain links to third-party websites or services (e.g. payment processors, identity verification, insurance). We do not control and are not responsible for their content, security, or practices. Your interactions with third parties are governed by their terms and privacy policies.
8. Limitation of Liability
To the maximum extent permitted by law, booking.bnbhost.ca, its affiliates, officers, directors, employees, contractors, and agents shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including loss of income, profits, reputation, or business; property damage, personal injury, or death; delays, cancellations, or force majeure; unauthorized access or destruction of data; errors or inaccuracies; or technical issues or failures. If liability cannot be fully excluded, our total aggregate liability shall not exceed the total service fees received for the specific booking giving rise to the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless booking.bnbhost.ca, its affiliates, and their officers, directors, employees, and agents from all claims, demands, liabilities, losses, damages, or expenses (including reasonable legal fees) arising from your use of the Services; your breach of this Policy or other terms; your violation of law or third-party rights; or your negligence, misconduct, or misrepresentation.
10. Force Majeure
booking.bnbhost.ca shall not be liable for failure or delay resulting from causes beyond its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government restrictions, power outages, network failures, cyberattacks, or pandemics.
11. Release of Claims
By using the Services you irrevocably release and discharge booking.bnbhost.ca from any and all claims, demands, and damages (actual or consequential) arising from or related to interactions or disputes with other users, Hosts, or Guests, whether online or offline.
12. Governing Law and Jurisdiction
Governed by the laws of British Columbia, Canada. All disputes to the exclusive jurisdiction of the courts of Vancouver, BC, or binding arbitration at booking.bnbhost.ca's discretion. We reserve the right to bring proceedings where a property is located or enforcement is required.
13. Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in full force and effect.
14. Acknowledgment and Acceptance
By using booking.bnbhost.ca or making a booking you acknowledge that you have read and understood this Policy; you accept that booking.bnbhost.ca acts solely as a booking intermediary; and you waive any right to claim damages beyond the limitations set forth herein.
