Terms of Service

Effective January 1, 2025 · Applies to all users of booking.bnbhost.ca

1. Agreement to Terms

These Terms of Service constitute a binding legal agreement between you (User, Guest, or Host) and booking.bnbhost.ca, governing your access to and use of our website, mobile application, and related services. By using the Services you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and our Cancellation and Refund Policy (incorporated by reference). If you do not agree, you must not use the Services.

2. Nature of the Platform

booking.bnbhost.ca is an online booking and property management platform connecting Guests with Hosts. We act solely as an intermediary facilitating communication, reservations, and payments. We do not own, operate, or control any listed properties. Each Host is solely responsible for the condition, legality, safety, and accuracy of their listing.

3. Eligibility and Account Registration

You must be at least 18 and have legal capacity to enter into binding contracts. To book or list you must create an account with accurate, complete, and up-to-date information. You are responsible for maintaining login credentials and all activity under your account. We may verify your identity using government-issued ID or other documentation and refuse or suspend accounts that do not meet verification requirements.

4. Booking Process and Payment Authorization

A booking is confirmed once full payment is received and a confirmation is issued. By completing a booking you authorize booking.bnbhost.ca and its payment processors to charge your payment method for the Total Booking Amount (taxes, service fees, deposits). Payments are processed by third-party providers (e.g. Stripe, PayPal, Adyen); you agree to their terms and privacy policies. Guests agree not to initiate chargebacks or payment disputes except for verified unauthorized card use; refunds and cancellations are governed exclusively by our Cancellation and Refund Policy.

5. Cancellations, Refunds, and Modifications

The Cancellation and Refund Policy in effect at the time of booking forms part of these Terms. Once the 48-hour grace period has expired, bookings become non-refundable as detailed in that policy. Modifications (dates or property) may require cancellation and re-booking at current rates.

6. Host Obligations

Hosts must ensure listings are accurate, lawful, clean, and safe; comply with local laws, zoning, licensing, taxation, and health and safety regulations; and are solely responsible for maintaining insurance and releasing booking.bnbhost.ca from liability arising from property damage, injury, or loss.

7. Guest Obligations

Guests must comply with House Rules, property instructions, and local laws; are responsible for damages, losses, or violations caused by them or their invitees; and agree not to use the property for unlawful purposes, events, or commercial filming without written permission.

8. Damage, Deposits, and Claims

We may require a security deposit or pre-authorization at booking. If the Host or property manager reports damage or loss we may charge the Guest's payment method up to the deposit amount or pursue recovery for actual costs. Guests will be notified and given an opportunity to dispute with supporting evidence.

9. Limitation of Liability

To the fullest extent permitted by law, booking.bnbhost.ca, its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or reputation, arising from use or inability to use the Services; condition or suitability of a property; actions of any Host or Guest; or unauthorized access to your account. Our total aggregate liability shall not exceed the amount paid by you for the booking giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless booking.bnbhost.ca, its affiliates, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from your use of the Services; your breach of these Terms or other policies; or injury, damage, or loss caused by your acts or omissions as a Guest or Host.

11. Intellectual Property

All content, design, trademarks, and software on booking.bnbhost.ca are the exclusive property of the Platform or its licensors. You have a limited, non-exclusive, non-transferable license to access and use the Services for their intended purpose. No content may be copied, reproduced, distributed, or used commercially without prior written consent.

12. Privacy and Data Protection

Use of the Services is subject to our Privacy Policy. By using the Platform you consent to collection and processing in accordance with that policy.

13. Dispute Resolution and Governing Law

This Agreement and any dispute arising from a booking are governed by the laws of British Columbia, Canada. Any claim, dispute, or controversy shall be submitted to the exclusive jurisdiction of the courts of Vancouver, BC, or binding arbitration at our discretion. We reserve the right to bring proceedings where a property is located or where enforcement is required.

14. Termination

We may suspend or terminate your access at any time, without notice, for violation of these Terms or applicable law.

15. Amendments

We may revise these Terms by posting an updated version. Continued use after modification constitutes acceptance of the revised Terms.

16. Severability

If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, Cancellation and Refund Policy, and any other referenced documents, constitute the entire agreement between you and booking.bnbhost.ca regarding the use of our Services.
